Requirements of the Regulatory Reform (Fire safety) Order 2005
The order came into force in October 2006 and requires that persons who own or have responsibility for certain type of building should appoint a "responsible person" to evaluate, consider, record and manage the fire safety risks presented to users of and visitors to the building.
The act applies to:
- Commercial premises (shops, offices etc)
- Industrial buildings (factories, warehouses etc)
- Public Buildings (libraries, museums, community halls, places of worship)
- Schools
- Healthcare premises
- Voluntary/charity premises
- Places of entertainment (clubs, pubs, restaurants etc)
- Other residential (hostels, hotels, Student accommodation etc)
- Temporary structures (marquees and tents)
- Common areas of private residential flats
One of the key responsibilities of the nominated person is to carry out a "fire risk assessment" which can be delegated to an appropriately qualified person.
The fire risk assessment must be maintained and reviewed where there is an incident or where risk may have changed. Penalties for not carrying out a risk assessment are enforced by the local fire authority and can involve issuing notices preventing or restricting use where a serious danger is identified.
